These Terms of Service govern your use of TourbillonTimepieces.com and purchases made from Tourbillon Timepieces.

Nothing in these Terms excludes or limits any mandatory rights that you may have under applicable consumer protection law.

Tourbillon Timepieces is the retailer and your contractual point of contact for purchases made through our store, including where a product is shipped directly by a manufacturer or fulfilment partner.

2. Scope of These Terms

These Terms apply to the use of our website and to purchases made from Tourbillon Timepieces.

Additional policies published on our website form part of the terms applicable to your purchase where relevant, including our:

• Withdrawal Form and information concerning statutory withdrawal rights

If there is a conflict between these Terms and a mandatory provision of applicable consumer law, the mandatory consumer law will prevail.

3. Use of Our Website

You may use our website only for lawful purposes and in a manner that does not interfere with the operation, security or availability of the website or the rights of others.

You must not knowingly introduce malicious software, attempt unauthorised access to our systems, misuse customer or website data, or use the website for fraudulent or unlawful activities.

Access to the website does not by itself create a sales contract.

4. Product Information

We make reasonable efforts to ensure that product descriptions, specifications, photographs, prices and availability information are accurate.

Watches are precision products and manufacturers may occasionally make minor changes to specifications, packaging or accessories. Such changes will not affect your statutory rights or permit us to supply a materially different product without your agreement.

Colours and visual appearance may vary slightly depending on lighting, photography and the display used to view the website.

If we discover a material error affecting a product you have ordered, we will contact you as soon as reasonably possible.

5. Availability and Limited Products

Some watches may be held in stock by Tourbillon Timepieces, while others may be sourced after an order is placed or supplied directly by an authorised manufacturer or fulfilment partner.

Limited editions, discontinued models and specialist watches may have restricted availability.

The presentation of a product on our website does not guarantee that it will remain available until an order is accepted.

If we cannot fulfil an order, we will inform you and provide any refund or other remedy required under applicable law.

6. Orders and Contract Formation

When you submit an order, you are requesting to purchase the products shown in your order at the price and on the terms presented at checkout.

An automated acknowledgement confirms that we have received your order. Where permitted by applicable law, such an acknowledgement does not necessarily mean that the order has been finally accepted.

A binding sales contract is formed when the order is accepted by Tourbillon Timepieces in accordance with applicable law.

We may decline an order before acceptance where there is a legitimate reason, for example:

• the product is unavailable;
• payment cannot be authorised or verified;
• the order triggers reasonable fraud or security concerns;
• we cannot legally ship the product to the destination;
• an export, import or other legal restriction prevents fulfilment; or
• there is an obvious pricing or listing error that could reasonably have been recognised as an error.

If payment has already been collected for an order that we cannot accept, the relevant amount will be refunded.

Once a binding sales contract has been formed, cancellation or modification by Tourbillon Timepieces will be subject to applicable law.

7. Prices and Payment

The price applicable to your purchase is the price presented to you at checkout before you place the order.

Prices may be displayed in different currencies depending on the store or market configuration. The final amount and currency presented at checkout will apply to your transaction.

Available payment methods are displayed at checkout and may vary by country or order.

Your bank, card issuer or payment provider may apply currency conversion charges or other fees that are outside the control of Tourbillon Timepieces.

Taxes, import VAT, customs duties and similar charges are handled as described at checkout and in our Shipping Policy.

We will not require you to pay additional delivery charges or other mandatory order charges that were not disclosed before the order was placed where applicable law requires such disclosure.

8. Shipping and Delivery

Shipping arrangements, estimated delivery times, tracking, insurance, customs matters and international delivery are described in our Shipping Policy.

Some products may be shipped directly from a manufacturer or authorised fulfilment partner. Direct fulfilment does not change Tourbillon Timepieces' role as the retailer and contractual point of contact for your purchase.

Delivery estimates are estimates unless expressly agreed otherwise. Delays caused by carriers, customs authorities or circumstances outside our reasonable control may occur.

Nothing in this section limits any statutory rights you may have in relation to delayed, lost or undelivered goods.

9. Right of Withdrawal, Returns and Refunds

Consumers may have a statutory right to withdraw from an online purchase.

For consumers in Norway and the EU/EEA, this is generally a 14-day right of withdrawal from receipt of the goods, subject to applicable exceptions.

Full information regarding withdrawals, returns, the condition of returned watches, return shipping, refunds and personalised products is provided in our Returns & Refund Policy.

A Withdrawal Form is also available through our website. Use of that particular form is not mandatory where applicable law permits the consumer to exercise the right of withdrawal through another clear statement.

Nothing in these Terms restricts any statutory withdrawal or cancellation right available to you.

10. Inspection and Use of Returned Watches

Where a statutory right of withdrawal applies, customers may inspect a watch to the extent reasonably necessary to establish its nature, characteristics and function.

Use or handling beyond what is reasonably necessary for inspection may result in a deduction corresponding to the actual reduction in value where permitted by applicable law.

This may be particularly relevant for high-value watches where scratches, wear, bracelet alterations, strap marks, unnecessary removal of protective materials or missing accessories materially affect the ability to resell the watch as new.

11. Personalised and Made-to-Order Products

Certain goods manufactured according to a customer's individual specifications or clearly personalised for that customer may be excluded from a statutory right of withdrawal where applicable law provides such an exception.

This can include individually engraved watches or products materially customised according to the customer's specific instructions.

A watch is not automatically considered personalised or non-returnable simply because it:

• has a high purchase price;
• was sourced specifically for an order;
• was not held in our own stock; or
• was shipped directly from a manufacturer.

Where a withdrawal exception applies to a personalised or custom-made product, we will endeavour to make this clear before the order is completed.

12. Defective or Non-Conforming Products

If a product is defective, damaged, incorrectly supplied or otherwise does not conform to the contract, you may have statutory rights to remedies such as repair, replacement, price reduction or refund.

These statutory rights are separate from any commercial or manufacturer's warranty.

Any manufacturer or commercial warranty offered with a watch is additional to, and does not replace or reduce, mandatory consumer rights.

Please contact Tourbillon Timepieces if you believe there is a problem with your product so that we can assist with the appropriate next steps.

13. Order Verification and Fraud Prevention

Because watches can be high-value goods, we may perform reasonable payment, identity, address or fraud-prevention checks before dispatching an order.

We may contact you if additional information is reasonably required to verify an order.

Where there are reasonable grounds to suspect fraud, unauthorised payment or other unlawful activity, we may delay or decline fulfilment to the extent permitted by law.

14. Intellectual Property

Unless otherwise stated, the original website content, text, layout, design and other material created by or for Tourbillon Timepieces are owned by or licensed to Tourbillon Timepieces.

Manufacturer names, trademarks, logos, product photographs and other third-party intellectual property remain the property of their respective owners.

You may not reproduce, commercially exploit or systematically extract substantial parts of our website without permission, except where permitted by law.

15. Third-Party Services and Links

Our website may use or link to services operated by third parties, including payment providers, carriers and other service providers.

Where you independently access a third-party website or service, its own terms and privacy practices may apply.

Tourbillon Timepieces is not responsible for independent third-party websites that we do not control. This does not affect our responsibility for third parties we use to perform our obligations to you where applicable law makes us responsible for their actions.

16. Liability

Nothing in these Terms excludes or limits liability or consumer rights that cannot lawfully be excluded or limited.

Tourbillon Timepieces remains responsible for performing its obligations under the sales contract and applicable consumer law.

To the extent permitted by applicable law, we are not responsible for losses that were not reasonably foreseeable as a consequence of a breach, or for losses caused solely by circumstances outside our reasonable control.

Nothing in these Terms excludes liability for fraud, wilful misconduct or any other liability that cannot legally be excluded.

17. Events Outside Our Reasonable Control

Circumstances outside our reasonable control may affect our ability to perform an obligation or meet an estimated delivery time. Examples may include severe transport disruption, natural disasters, war, governmental restrictions, customs disruption, strikes outside our organisation or failure of essential third-party infrastructure.

Where such circumstances materially affect an order, we will take reasonable steps to minimise the impact and communicate with you where appropriate.

Any statutory rights you have to cancel the contract, obtain a refund or pursue another remedy remain unaffected.

18. Privacy

Our processing of personal information is governed by our Privacy Policy.

Our online store is powered by Shopify, which provides the ecommerce infrastructure used to operate the website and checkout.

19. Changes to These Terms

We may update these Terms from time to time to reflect changes in our business, services, technology or legal requirements.

Any updated Terms will apply prospectively from the date they are published unless applicable law requires otherwise.

The terms applicable to an existing sales contract will generally be those in effect when the relevant order was placed. We will not retroactively alter a concluded consumer contract merely by publishing new Terms on the website.

20. Governing Law and Consumer Protection

These Terms and contracts with Tourbillon Timepieces are governed by the laws of Norway, subject to applicable rules on consumer protection and choice of law.

If you are a consumer residing in another country, this choice of Norwegian law does not deprive you of mandatory consumer protections that apply to you under the law that would otherwise govern your purchase.

Nothing in these Terms prevents you from exercising rights available under mandatory consumer law in your country of residence where those rights apply to the transaction.

21. Complaints and Dispute Resolution

We will attempt to resolve the matter directly with you.

Consumers in Norway may, where the relevant conditions are met, submit a consumer dispute to Forbrukertilsynet (the Norwegian Consumer Authority) for mediation. Eligible disputes that are not resolved through mediation may be brought before Forbrukerklageutvalget (the Norwegian Consumer Disputes Commission).

Consumers in other countries may also have access to competent courts, consumer authorities or alternative dispute-resolution mechanisms under applicable law.

Nothing in this section restricts any mandatory right to bring a claim before a competent court or dispute-resolution body.

22. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or disregarded only to the extent necessary, and the remaining provisions will continue to apply.
